Text version of the "Private and Confidential" document
Dear Brett,
Following an additional SBW Committee meeting held on Tuesday 5th March, 2024, the Committee agreed on the following judgements in relation to your recent conduct:
- The Committee considered your conduct on 6th February in circulating by email the David Campbell document of 10th September 2023 to all Committee members without the informed prior consent of the author, the author's partner referenced in the document or the Committee. The Committee judged this conduct to be prejudicial to the interests of SBW in that the conduct constituted an invasion of privacy of the author, the author's partner and those Committee members who had not previously seen the document.
- The Committee judged your conduct in August or September 2023 in posting on the public-access area of the SBW website, a document titled "The Term of the President", without the Committee's prior authorisation or knowledge, to be prejudicial to the interests of SBW in that the conduct:
- in the absence of informed prior consent of the SBW members named in the document, constituted an invasion of privacy of several SBW members about whom adverse inferences could be drawn by anyone reading it online;
- was liable to lead to reputational damage to SBW by publicly airing a previous internal and settled dispute about the changes made to the SBW's constitution in August 2023; and
- was contrary to SBW's interest in maintaining control over what material, particularly contentious material, enters the public domain in the name of SBW.
The Committee's discretionary power under Rule 6(a) of the SBW Constitution to cancel your membership could have flowed from the above two judgements. At this point, the Committee has not resolved to exercise this discretionary power, having regard to the following extenuating circumstances:
- your previous considerable contribution to establishing and maintaining the SBW website and your ongoing current support of the group managing the new SBW website;
- your previous service to SBW across a number of Committee roles and as a respected walk leader, which warranted life membership; and
- your ongoing participation in walks, sharing your considerable walking experience with others.
However, the Committee reserves the right to revisit the exercising of its power under rule 6(a) of the SBW constitution, should you further engage in conduct to which Rule 6(a) applies.
You are reminded that Committee related emails must be sent to the info@shoalhavenbushwalkers.com box, and not to Committee member's personal email addresses.
