In the first part of the committee meeting minutes for August and September 2023, on page 5 under General Business, item 2.1 Risk Manager position, the 5th dot point states “It was also agreed to set up a sub-committee to review and simplify the Safety procedures that have previously been tabled – committee to be John Kubale, the Risk Manager when appointed and Andy Winfield.”
In the second part of the committee meeting minutes for August and September 2023 on page 14 under General Business, item 1 states “Report back from sub-committee (Greg Smith, John Kubale and Andy Winfield) set up to review and simplify the Safety procedures that have previously been tabled. Two documents were distributed as background to the considerable work that has been done by this sub-committee.”
At the October meeting, where Greg was supposed to “present a refined document”, President John Kubale thanked Greg and Andy for their comprehensive safety and risk documentation. Under General Business item 1 it says that Greg gave a short presentation involving a risk assessment, three new procedures, three updated procedures and ten new Guidance / Information documents. It was then proposed “that the Safety and Risk documents presented by Greg Smith on behalf of the Safety sub-committee be approved and uploaded on the new SBW website. Proposed Greg, Seconded Andy, Passed”.
The constitution in Rule 24. Delegation by committee to Sub-committee (a) says "A Sub-committee shall deal with matters of a special nature and shall be confined to the terms under which the Sub-committee is established."
The safety sub-committee of John Kubale, Greg Smith and Andy Winfield was set up "to review and simplify the Safety procedures that have previously been tabled". They should not have done "considerable work'. They did not need to produce "comprehensive safety and risk documentation". Instead of what the committee asked for - a simplification of a four page document - the committee received a large number of additional documents including "a risk assessment, three new procedures, three updated procedures and ten new Guidance / Information documents".
John Kubale, Greg Smith and Andy Winfield had exceeded the terms under which the Sub-committee was established, and had therefore been unaware of, had misunderstood or had deliberately ignored Rule 24 (a) of the SBW constitution.
In addition, and this is not actually related directly to the complaint, at no time during the whole process were any documents from the sub-committee included in any committee meeting minutes. Even the excessive number of final documents was not included in the minutes - so there is no documentation showing that the safety procedures on the website are the documents that were approved by the committee. If that is actually the case, then that is just slack committee work.
