Hi SBW committee,
Section 13 of the SBW constitution says that a complaint may be made against a member of the Club who has refused or neglected to comply with a provision or provisions of the constitution, or who has willfully acted in a manner prejudicial to the interests of the Club.
In this complaint I will explain how John Kubale, John Souter and Kynie Evison refused or neglected to comply with a provision or provisions of the constitution and willfully acted in a manner prejudicial to the interests of the Club by keeping SECRET a complaint emailed to the President by David Campbell in early September 2023 that should have been regarded as Correspondence In, then forwarded to the club secretary, and shared with - and actioned by - the entire committee.
Rule 19b of the SBW constitution says that the Secretary shall maintain records of correspondence. The President should have forwarded the David Campbell email to the Secretary so that she could maintain the record of the correspondence. His failure to do so therefore violates Rule 19b. If, as a result of this complaint, the committee decides that there was no compulsion for the President to forward this correspondence to the Secretary, then they will set a dangerous precedent.
In September 2023, SBW President John Kubale received a complaint from David Campbell dated September 10th titled "REQUEST FOR ACTION TO ADDRESS DAMAGING BEHAVIOURS IN SBW". This document was used in a non-constitutional complaints meeting arranged by John Kubale and attended by John Souter, Kynie Evison and myself on the following day - September 11th. This meeting will be the subject of another complaint. I was given a copy of the David Campbell email at that meeting.
I resigned from the committee on September 16th as a direct result of that non-constitutional complaints meeting. On the morning of September 17th I emailed David Campbell not only to comment on the allegations in his complaint and to clear up some differences of opinion, but also to assure him that I had not resigned because of his complaint. I finished off that email by saying -
"You will probably have heard by now that I resigned from the SBW committee and the position of SBW website administrator yesterday. There were many reasons for my resignation, but your complaint was not one of them - apart from the way it was handled by President John Kubale. He chose to ignore the procedure for handling complaints as laid down in the SBW constitution under "Rule 13. Disciplining of members". Instead, John decided to go about the process his own way, in very much the same way that his predecessor ignored the rules as well. The main reason for my resignation was simply that I don't wish to be associated with the many bad decisions made by the President and the committee over the past year or two, or with the imminent bad decisions about to be announced."
I suspect that when David received my email he was alarmed that John Kubale had shared the contents of his original complaint with me, because David then sent another email to John apparently requesting that it be treated as "a confidential briefing" and in which he repeated his recommendations for a code of conduct etc. This email was sent on September 17th and was titled "SBW Moving Forward".
The September SBW committee meeting was held on September 18th. The minutes of that meeting show three items of Correspondence In - an email complaint from Graeme and Lyndal Lawless, my resignation from the committee , and the email from David Campbell sent on September 17th with the subject of "SBW Moving Forward".
The complaint email sent on September 10th with the subject of "REQUEST FOR ACTION TO ADDRESS DAMAGING BEHAVIOURS IN SBW", and used in the unconstitutional complaints meeting on September 11th, was not tabled at the committee meeting on September 18th and apart from John Kubale, John Souter, Kynie Evison and myself, it was apparently never made known to the rest of the committee as future events would prove.
